Toxic torts are a type of personal injury in which the plaintiff claims chemical exposure, most commonly from pharmaceutical drugs or occupational exposure. The occupational toxic tort cases differ from Workers’ Compensation cases in that the plaintiff does not file against the employer but files the claim against a third party, usually manufacturers or distributors of the toxic chemicals.
