NEW YORK AREA’S BEST LAWYERS

Congratulations to Ken R. Rothschild, Esq., and Jeff M. Kadish, Esq., on their selection as Best Lawyers in America® for 2011! The Best Lawyers in America is one of the most highly regarded and widely utilized referral list of lawyers in the nation. Lawyers included on the list are selected for the honor through a rigorous peer-review process of surveys and extensive telephone interviews. Best Lawyers has set the gold standard for integrity and reliability for nearly
28 years — and because lawyers are not allowed to pay a fee for inclusion, Best Lawyers is known as the most objective, unbiased source of legal referrals anywhere. Kudos to Ken and Jeff for their selection to be included on this prestigious list of attorneys.

CYBER LIABILITY IN AN E&O WORLD

In October 2010, Audrey L. Shields and Kenneth R. Rothschild presented a seminar to a group of approximately 120 insurance agents and brokers regarding “Cyber Liability in an E&O World.” The seminar addressed a number of issues relating to cyber threats which present new and different liabilities and exposures for companies across most industries around the world.

To date, a standard of care for agents and brokers has not yet been specifically developed in this area which makes a potential Errors & Omissions claim riskier because agents and brokers will be measured against much more subjective standards. There are now a number of new risks for businesses that agents and brokers have been working with for a long time which must be considered. Ultimately, the risks involved are really no different than any other E&O exposure and thus far, there are no reported decisions directly applicable to E&O claims in a cyber liability arena.

Insurance companies and agents must also be aware of potential E&O exposures that may result from the use of social networking. These exposures are most likely to result from a failure to procure coverage, a failure to process a service request, or reliance upon incomplete or misleading information about a product.
