Firm Highlights

Jeffrey S. Bell has been certified as an Arbitrator by the New Jersey Adminstrative Office of the Courts and is approved to arbitrate matters in Middlesex and Somerset counties.

Kenneth R. Rothschild and Christopher H. Westrick achieved a significant result on a motion filed in a $27 Million ngineering malpractice matter. In a matter arising out of alleged design deficiencies in a large industrial facility, they
successfully had approximately $19 Million of the claimed damages dismissed based upon a contractual damage limitation.

Philip A. Garubo, Jr. and Jeffrey S. Bell recently completed a six week trial in a case involving complex issues and testimony from over forty witnesses including seven experts. The trial was the result of a devastating fire at a residential apartment complex which spread to neighboring properties, destroying multiple homes. While there were no physical injuries, there were claims for emotional distress and loss of property. Although the jury returned a finding of liability on one count of the complaint, the verdict was favorable to the defense in that it totaled less than the “low” on a proposed “high/low” agreement, and was approximately 25% of the plaintiffs’ global settlement
demand during jury deliberations.
