Golden Rothschild is pleased to announce that Christopher H. Westrick and Catherine M. Shiels have authored a chapter in a new booked entitled "Construction Insurance: A Guide for Attorneys and Other Professionals", which was published by the American Bar Association in April 2011. Mr. Westrick and Ms. Shiels wrote Chapter Four of the book on the subject of Workers' Compensation and Employers' Liability Insurance in the construction litigation context. This chapter discusses a variety of sub-topics including general principles of Workers' Compensation, common Workers' Compensation issues in Construction matters (independent contractor versus employee, relationship between owners, general contractors and subcontractors, leased and special employees, joint ventures, attempts to restrict Workers' Compensation by contract, illegal aliens and undocumented workers), exceptions to the Workers' Compensation exclusivity provision, third party actions by injured employees against non-employers, pass-through tort liability to employers, and settlements including subrogation, liens and Medicare and Medicaid.
